The concept of "professional standard" was introduced in Labor Code five years ago by Federal Law No. 236-FZ of December 3, 2012. Since then, it has become firmly established in everyday life. The Ministry of Labor almost daily approves new standards, the application of which has become mandatory for a number of organizations. In order for the information to be systematized, and any employer or citizen to be able to find the information he needs, a register was created professional standards. The Ministry of Labor of Russia became the operator of the resource.

According to the norms labor law professional standards are a requirement for the qualifications of specialists necessary for them to perform professional activity. Qualification, in turn, includes a list of knowledge and skills, experience and professional skills that an employee must possess. The Ministry of Labor of Russia is engaged in the development and approval of professional standards, while the list of specialties is formed taking into account priority areas development of the economy and proposals of the National Council under the President of the Russian Federation for professional qualifications. The Labor Code regulates these requirements.

In order for any employer or specialist to find the description and requirements for each profession for which a standard already exists at the right time, the professional standards approved by the Ministry of Labor in 2019 are combined into a special register. It is a detailed information system, which defines the relevant qualification requirements for the specialties included in it. In the registry you can find:

  • definitions linking the spheres of professional work;
  • descriptions that help to focus on real experience specialists, and not on programs of an educational nature;
  • a list of powers and responsibilities of employees holding a certain position;
  • the degree of responsibility by type of activity;
  • other useful information.

The basis for the development of approval, application of requirements are carried out by the department according to the rules established by the decree of the Government of the Russian Federation. In addition, there is an official website "Professional Standards", which is promptly updated. For ease of search and use, specialties are listed in it in alphabetical order.

Mandatory application of professional standards

Until July 1, 2016, the application of professional standards approved by the Russian Ministry of Labor was not mandatory and was of a recommendatory nature. However, from this date, it began to operate, which regulates the procedure for their application. In particular, it says that if the Labor Code, other federal laws, other regulatory legal acts of the Russian Federation establish qualification requirements, necessary for the employee to perform a certain labor function, professional standards are mandatory for employers to apply. Other organizations may follow these requirements at their discretion.

So, specialists of the Ministry of Labor explain that in order to determine labor functions when concluding or amending employment contracts according to the norms article 57 of the Labor Code of the Russian Federation, prerequisite is an indication of labor functions. Therefore, when specifying positions in staffing employers are recommended to use the names of the positions contained in the corresponding block of the third section of the document, they are also contained in the register of professional standards 2019. What useful can those employers learn from it, for which it is not yet mandatory to apply the established requirements in practice? Such information includes, in particular:

  • information to form the basis personnel policy organizations;
  • standards for establishing a system of remuneration;
  • data to determine specific labor functions for each employee;
  • the formulation of the main duties of employees;
  • assistance in development job descriptions;
  • requirements for training and certification of employees.

Organizations for which qualification requirements for employees have become mandatory:

  • state institutions and organizations;
  • open joint-stock companies(with the exception of credit institutions);
  • insurance organizations;
  • non-state pension funds;
  • joint-stock investment funds;
  • management companies mutual investment funds;
  • other economic entities, securities which are admitted to circulation at organized auctions (with the exception of credit organizations) or carried out through online cash desks;
  • state off-budget funds.

All these organizations are required to hire chief accountants or other employees who are responsible for keeping records, only in accordance with professional standards, as provided Federal Law No. 402-FZ of December 6, 2011"About Accounting". For other industries, strict requirements for other positions and specialties may be established, so employers must monitor this on their own, which can be helped by the register of professional standards of the Ministry of Labor.

Relevance of data in the registry

Professional standards (PS) are intended to determine the qualification level required for a particular specialty. Recommendations for the application of professional standards are effective from July 1, 2016, after the introduction of Art. 195.1 - 195.3 of the Labor Code of the Russian Federation. Job titles depending on professional standards

The developed professional standards (PS) cover the activities of the profession, not limited to a specific position. As a result of the implementation of the PS and changes in the functions of the enterprise, they can rename positions previously approved by the staffing table.

The names of positions that involve prerogatives in the form of compensation, preferential service or restrictions due to special working conditions should be named according to the names of the tariff directory. Professional standards: the need for the development and implementation of professional standards

Professional standards are regulations and optionally can be used as the basis for creating local acts or use in an activity.

Enterprises use professional standards in the following cases:

  • Development of a system of requirements when conducting a competition for filling a vacant position, presenting requirements for employment;
  • Preparation of job descriptions for employees of the staffing table;
  • Definitions optimal system remuneration for specific positions;
  • Development of a training plan or performance appraisal of employees;
  • Determination of the optimal personnel management system.

The introduction of the professional standard is carried out by a commission acting on the basis of an order. The development of PS is carried out by the Ministry of Labor and Social Protection. At the stage of proposal development, enterprises, professional communities, self-regulatory organizations or other persons. The Ministry of Justice is responsible for approving professional standards.

Register of professional standards and sub-registries

The systematization of approved professional standards is carried out by recording in the register. The data is grouped by areas of professional activity. The register includes sub-registries:

  • Register of PS in the form of a list of approved registers by type of activity;
  • A list of councils containing information about organizations that have the powers of a qualifications council and formed commissions or initiative bodies. The sub-registry indicates the grounds for empowering the councils and the persons responsible for their work.

The registry information contains data on planned changes in databases, new developments in the field of professional requirements. Replenishment of new standards is carried out primarily for professions of priority areas in the economy. The standards under development are not a normative act until approved by the Ministry of Justice.

The norms used in the development of the PS are contained in the methodological recommendations approved by order of the Ministry of Social Protection of the Russian Federation of April 29, 2013 No. 170n. Based on the provisions of the order, the PS must include sections:

  • General provisions on the professional standard. Specifies the view economic activity in which PS is used. The section contains the tasks of the profession, purpose, description of activities;
  • Characteristics of labor functions of professional activity. The description is carried out in general for the profession and separately for each of the possible levels;
  • Description of generalized functions. The section indicates the origin of the generalized function, a possible list of job titles in accordance with directories, qualification requirements and other characteristics;
  • Information about the professional standard developer. It is the responsibility of the developer to ensure that the project is discussed using the tools mass media.

Consequences of the introduction of PS for employees

When implementing a PS, the employer must apply the requirements not only to newly hired employees, but also to those working under labor contracts. The employer has the right to take actions:

  • Check the compliance of the employee's skill level with the requirements. Certification is carried out by the commission of the enterprise or the training center;
  • If the conditions change, conclude an additional agreement drawn up in writing as agreed by the parties (Article 72 of the Labor Code of the Russian Federation). The employer has the right to issue a new job description with the same job function. The employee is notified in advance of a change in conditions with a proposal to switch to new conditions or dismissal in case of refusal;
  • If the employee refuses to switch to new conditions and the availability vacancies the employer must offer them to the employee;
  • Dismiss an employee under paragraph 7 of part 1 of Art. 77 of the Labor Code of the Russian Federation.

The approval of a new job description is not a change in the labor function and cannot be challenged by the employee in court.

Responsibility of an employer not applying professional standards

Enterprises that use professional standards as a recommendation are exempted from liability for their non-application. Sanctions are imposed on employers who have professions in their staff, the application of PS to which is mandatory.

Refusal to apply the standards is recognized as an administrative offense under paragraph 4 or 5 of Art. 5.27 of the Code of Administrative Offenses.

The procedure for entering standards at the enterprise

Answer: Legislation establishes a unified procedure for the application of professional standards for enterprises, regardless of the organizational form.

Answer: Dismissal of employees who do not meet the requirements of the PS is not provided for by law. The employee is invited to undergo certification, advanced training. So, we have considered the main changes that come into force on July 1, 2016 in terms of professional standards, the norm of Article 195.3 of the Labor Code of the Russian Federation begins to work. These requirements can be "scattered" anywhere: in the Labor Code of the Russian Federation, federal laws, regulatory legal acts of the Russian Federation. “From July 2016, employers need to be very careful not to miss any federal law or regulation that may establish qualification requirements for their employees. It will be necessary not only to take into account the qualification requirements established by these regulatory legal acts, but also to check the existence of an accepted professional standard for the relevant work.

The fact is that in federal laws, regulatory legal acts, qualification requirements are often given only in general view, and in the professional standard the type of education, the direction of training, etc. can already be specified. For example, in Federal Law No. 402-FZ “On Accounting” for the chief accountant of JSC and other organizations specified in Part 4 of Art. 7 , established availability requirements higher education and some work experience. In the professional standard "Accountant", approved by the Order of the Ministry of Labor of Russia dated December 22, 2014 No. 1061n, the requirement for education is supplemented by the passage by the chief accountant of additional professional programs- advanced training, programs professional retraining.

Please note that there are no major changes from July 1, 2016. Working group on the introduction of professional standards

To implement professional standards, the employer needs to create a working group. The task of the group is to develop a plan for the application of professional standards by the employer. The working group is created by order of the head. The number and composition of the members of the working group is determined solely by the employer. It is recommended to include in the working group labor economists or those employees who are responsible for the development of the staffing table, personnel management specialists, lawyers, and possibly managers structural divisions. In the plan for the transition to professional standards, it is necessary to prescribe in detail the actions, deadlines and persons responsible for each stage.

The first thing that the working group has to do is to correlate the positions available to the employer with professional standards. This is the most global and time-consuming work, because. at the same time, one cannot rely only on the name of the position (profession) in the staff list and the name of the professional standard itself. It is necessary to find those professional standards that can potentially fit the positions (professions) indicated in the staff list. To do this, you need to correlate the main goal of professional activity according to the standard (column "The main goal of the type of professional activity" of the professional standard) with the goal of working in the position (profession) with the employer, additionally paying attention to the column "Occupation group" in the general information section.

After the positions, professions that the employer has are correlated, and the professional standards that are to be applied are identified, working group draws up a report. The report should reflect the list of accepted professional standards, according to which the employer has activities. This list will form the basis for further actions.

If the employee does not meet the professional standard - conduct certification

In practice, not all employees can meet the requirements set out in professional standards.

Example: the employee is engaged in the types of work named in Art. 30 of the Federal Law of December 28, 2013 No. 400-FZ “On insurance pensions”, for example, in underground work. The position of the employee should be called as indicated in the professional standard or qualification directory. And his knowledge, skills, work experience must correspond to qualification requirements given in the professional standard. The employer found out that there is an employee holding a certain position, and there are professional standard requirements, but the employee does not meet them. What to do with such an employee?

It is impossible to dismiss due to non-compliance with the professional standard. The employer can carry out certification. To do this, it will be necessary to develop a whole system of local regulations that describes the procedure, the procedure for conducting attestation. It will be necessary to create a commission, to determine the criteria by which we will evaluate the employee. Based on the results of the certification, the commission will draw conclusions: whether the employee corresponds to the position held or not.

Suppose an employee does not meet the qualification requirements. Can I be fired for this reason? - this question remains open today. But employers should take into account that certification should not be carried out in order to get rid of "extra" employees, but in order to determine which of them to send for training and advanced training. The goal should be good - to bring existing workers to the required level.

Important: Employers may decide to send employees to advanced training courses or retraining in order to achieve compliance with the requirements of professional standards. But this is a right, not an obligation of the employer! The employer himself determines the need for training (vocational education and professional education) and additional vocational education workers (Article 196 of the Labor Code of the Russian Federation, paragraph 11 of the Information of the Ministry of Labor of 04/04/2016).

New employees who will be hired after July 1, 2016 must be clearly selected according to the established qualification requirements, which are spelled out in professional standards. This applies only to employers whose employees:

  1. the Labor Code, other federal law or regulatory legal act specifies qualification requirements

and/or

  1. in accordance with Part 2 of Article 57 of the Labor Code of the Russian Federation, the performance of work is associated with the provision of benefits, compensation, or there are restrictions for employees.

All other employers use professional standards as a basis - for them, professional standards are advisory, not mandatory.

How to apply professional standards correctly:

What are professional standards and where can I find them?

A professional standard is a characteristic of the qualifications necessary for an employee to carry out a certain type of professional activity. This is the literal wording of Part 2 of Article 195.1 of the Labor Code of the Russian Federation. In practice, a professional standard is a document that describes the labor functions for a particular type of activity, as well as the requirements for knowledge, skills and work experience of specialists performing these functions. The so-called "professional passport".

As of June 2016, 812 professional standards have been approved. The register of professional standards is maintained and updated by the Ministry of Labor of Russia.

Qualification guides and professional standards - are they different concepts?

Yes. Separately, there are qualification reference books, professional standards are published separately. It is assumed that professional standards will gradually replace qualification reference books. See paragraph 4 of the letter of the Ministry of Labor of 04.04.2016 No. 14-0 / 10 / V-2253.

If the qualification handbook and professional standard for similar professions (positions) contain different requirements to qualification, the employer independently determines which regulatory legal act he uses, with the exception of cases provided for by federal laws and other regulatory legal acts Russian Federation(paragraph 5 of the letter of the Ministry of Labor dated 04.04.2016).

Is professional standard a compulsory condition for work or at the request of the employee himself?

If desired, the employee can familiarize himself with the text of the professional standard for the profession in which he works. No one has the right to force him.

But if the employer is obliged to apply professional standards, he will ensure that employees comply with them. Those who do not meet the requirements, the employer can "pull up" and send for training. And from July 1, 2016, new personnel will be recruited in accordance with the requirements in professional standards.

If the employer is not obliged to apply professional standards (read about this at the beginning of the article), then he has the right to use them voluntarily.

Is it necessary to change the names of positions in the staff list and work books employees due to changes from July 1, 2016?

Job titles must match qualification guides or professional standards not in connection with the entry into force of Art. 195.3 of the Labor Code of the Russian Federation, and in connection with Part 2 of Art. 57 of the Labor Code of the Russian Federation, i.e. when the provision of compensations and benefits or the presence of restrictions is associated with the performance of work in certain positions, professions, specialties.

Firstly, the professional standard cannot be passed, because this is not a test or a set of tasks. Roughly speaking, this is a set of characteristics that an employee meets or does not meet.

Requirements are spelled out in professional standards for various professions.

Secondly, there is no coveted list of places where you can get training and “pull yourself up” to the desired level. There is a requirement for an organization that conducts training - it must have a license to carry out educational activities under the relevant program (Part 1, Article 91 of the Federal Law of December 29, 2012 No. 273-FZ “On Education in the Russian Federation”).

Many professional standards mention additional education. These are professional development and professional retraining programs. The minimum allowable period for mastering advanced training programs is 16 hours, professional retraining programs - 250 hours (clause 12 of the Procedure, approved by order of the Ministry of Education and Science of Russia dated July 01, 2013 No. 499). How do I know if I need to take training?

To get started, read the text of the professional standard for your profession. Check if you meet the specified requirements for education, work experience, etc. Remember, the texts of professional standards are not always the end point. For some categories of workers, the legislation imposes additional qualification requirements, they must be sought in federal laws and regulations. And these requirements may differ from the requirements given in professional standards. All requirements must be taken into account.

If you understand that you do not fully meet the requirements, you can independently pull yourself up to the required level, undergo training and receive a document. This decision can be made by your employer.

From July 1, 2016, those employers who are required to apply professional standards will select personnel according to qualification requirements in accordance with the requirements in professional standards.

1. 2. Coding of professional standards (types of professional activity) and filling in column 3 of the register is carried out in accordance with a 2-facet code combination. The structure of the code designation includes 2 groups of digital decimal places and looks like: XX.XXX, where:

the first two characters are the code of the area of ​​professional activity;

the next three characters are the code for the type of professional activity (professional standard within the scope of professional activity).

For example, 01.001 is a professional standard code related to the field of professional activity "Education" and the type of professional activity 001.

3. Counts 2" Registration number professional standard", 3 "Professional standard code", 5 "Type of professional activity" and 6 "Professional standard name" are filled in in accordance with the data contained in the corresponding columns of section "I. General information"professional standard.

4. In column 4 "Field of professional activity" the name of the field of professional activity is indicated in accordance with the table provided for in paragraph 1 of these notes.

5. Column 11 "Date of entry into force" indicates the date of entry into force of the professional standard in accordance with the order of the Ministry of Labor of Russia. When a professional standard is put into effect from the moment the order of the Ministry of Labor of Russia is issued, a dash is put in this column.

6. Columns 7 and 8 "Order of the Ministry of Labor of Russia", 9 and 10 "Registration number of the Ministry of Justice of Russia", 12 and 13 "Letter to the Ministry of Education and Science of Russia" indicate the details of the relevant documents.
