The procedure for reimbursement to the arbitration manager of expenses for notifying creditors of the presentation of claims of the authorized body against the debtor

1. This Procedure defines the rules and conditions for reimbursement by the federal body executive power, authorized by the Government of the Russian Federation to present in a bankruptcy case and in the procedures applied in a bankruptcy case, claims for mandatory payments and claims of the Russian Federation for monetary obligations (hereinafter referred to as the authorized body), to the arbitration manager of the costs of notifying creditors of the presentation of claims of the authorized body in accordance with the Federal Law of October 26, 2002 N 127-FZ "On Insolvency (Bankruptcy)" (Collected Legislation of the Russian Federation, 2002, N 43, Art. 4190; 2004, N 35, Art. 3607; 2005, N 1, item 18, 46; N 44, item 4471; 2006, N 30, item 3292; N 52, item 5497; 2007, N 7, item 834; N 18, item 2117; N 30, 3754; N 41, item 4845; N 49, item 6079; 2008, N 30, item 3616; N 49, item 5748; 2009, N 1, item 4, 14; N 18, item 2153; N 29, item 3632; N 51, item 6160; N 52, item 6450; 2010, N 17, item 1988; N 31, item 4188).

2. Simultaneously with sending the relevant claims to the bankruptcy trustee, the authorized body sends him a request for an invoice for payment of reimbursement to the bankruptcy trustee of expenses for notifying creditors of the claims of the authorized body against the debtor (hereinafter referred to as the Invoice), containing the following mandatory information:

a) the name of the document - "Invoice";

b) the date of the Invoice;

c) name of the debtor, his address and information identifying the debtor (public registration number records of state registration legal entity, state registration number of the entry on state registration individual entrepreneur, identification number of the taxpayer), in respect of which the arbitration manager exercises the relevant powers, the number of the bankruptcy case of the debtor;

d) last name, first name, patronymic of the bankruptcy trustee, taxpayer identification number, status of the arbitration trustee (interim trustee, administrative trustee, external trustee, bankruptcy trustee);

f) the amount of compensation to the arbitration manager for the costs of notifying creditors of the claims of the authorized body in monetary terms in rubles;

g) bank account details for transfer by the authorized body Money;

h) personal signature of the arbitration manager;

i) the seal of the arbitration manager (if any).

3. The request of the authorized body specified in paragraph 2 of this Procedure must contain information on the need to submit to the authorized body:

Accounts within three working days after receiving the request;

documents confirming the actual implementation by the arbitration manager of the expenses for notifying creditors of the presentation of claims of the authorized body, indicating the amount of expenses, their intended purpose and the date of their implementation (receipts for payment of postage, registers postal items or other documents), within ten days after the insolvency practitioner has incurred the relevant expenses.

4. Simultaneously with sending claims to the arbitration court for inclusion in the register of creditors' claims, the authorized body sends to the arbitration court in the bankruptcy case of the debtor a copy of the request specified in paragraph 2 of this Procedure, with the attachment of documents confirming the direction of the specified request to the arbitration manager.

5. Payment of reimbursement to the arbitration manager of expenses for notifying creditors of the presentation of claims of the authorized body is carried out within five working days from the date of receipt of the Invoice by the authorized body (but no later than the period necessary to ensure timely consideration of the claims of the authorized body by the arbitration court) by transferring monetary funds by the authorized body funds according to the bank account details specified in the Account.

6. If the bankruptcy commissioner fails to submit an Invoice within the time period specified in paragraph 3 of this Procedure, the authorized body shall send to the arbitration court a demand to compel the bankruptcy commissioner to submit an Invoice indicating the reasons for the impossibility of the authorized body to reimburse the expenses of the arbitration manager for notification of creditors.

7. Disagreements between the insolvency practitioner and the authorized body regarding the amount and validity of the costs of notifying creditors are considered in arbitration court in the manner prescribed by Article 60 of the Federal Law of October 26, 2002 N 127-FZ "On Insolvency (Bankruptcy)".

List of documents for registration of accreditation

To obtain accreditation from the Ministry of Telecom and Mass Communications, a representative of the CA should send an application to the agency for an accreditation certificate and a package of necessary documents:

Accredited certification centers must ensure their liability to third parties for possible losses in the amount of 1.5 million rubles by submitting to the GCC the supporting document specified in clause 5 of the previous section. Such a document could be:

  • guarantee agreement;
  • bank guarantee (the CA should additionally indicate the license number of the bank);
  • liability insurance contract (the GCC checks the presence of an insurance company in the Unified State Register of Insurance Entities).

CA receives accreditation and digital signature

Application for accreditation of certifying centers of electronic signature is considered within 30 days, during which the GCC makes a decision to issue or refuse to issue an accreditation certificate. In case of a positive response, the Ministry of Telecom and Mass Communications draws up the decision document itself within 5 days. Within 10 days from the date of the decision, sends a notification to the CA and issues an accreditation certificate and a qualified certificate generated using the tools for creating a signature by the Ministry of Communications. And after the issuance of the certificate, within 24 hours, it places information about the new CA on a single portal. If a negative decision is made, the GCC sends a corresponding notice on paper to the CA indicating the reasons for the refusal.
