1. Approve, in agreement with the Ministry of Labor and Social Protection of the Russian Federation, the attached Procedure for the certification of teaching staff of organizations engaged in educational activities.

2. Establish that the qualification categories established for teachers of state and municipal educational institutions prior to the approval of the Procedure specified in paragraph 1 of this order are retained for the period for which they were established.

3. Recognize invalid the order of the Ministry of Education and Science of the Russian Federation dated March 24, 2010 N209 "On the Procedure for Attestation of Pedagogical Workers of State and Municipal Educational Institutions" (registered by the Ministry of Justice of the Russian Federation on April 26, 2010, registration N 16999).

The procedure for attestation of teaching staff of organizations engaged in educational activities

I. General provisions

1. The procedure for attestation of pedagogical workers of organizations engaged in educational activities (hereinafter referred to as the organization) determines the rules, main tasks and principles for attestation of pedagogical workers of organizations.

This Procedure applies to teaching staff of organizations filling positions named in subsection 2 of section I of the nomenclature of positions of teaching staff of organizations engaged in educational activities, positions of heads of educational organizations, approved by Decree of the Government of the Russian Federation of August 8, 2013 N 678 (Collection of Legislation of the Russian Federation , 2013, N 33, art. 4381), including in cases where the filling of positions is carried out part-time in the same or another organization, as well as by combining positions along with work in the same organization, defined by an employment contract (hereinafter - pedagogical workers).

2. Certification of teaching staff is carried out in order to confirm the compliance of teaching staff with their positions based on an assessment of their professional activities and at the request of teaching staff (with the exception of teaching staff from among the teaching staff) in order to establish a qualification category 1.

3. The main tasks of certification are:

stimulation of purposeful, continuous improvement of the level of qualification of pedagogical workers, their methodological culture, professional and personal growth;

determining the need for advanced training of teaching staff;

improving the efficiency and quality of teaching activities;

identifying prospects for using the potential of teaching staff;

taking into account the requirements of federal state educational standards for personnel conditions for the implementation of educational programs when forming the personnel of organizations;

ensuring the differentiation of wages for teachers, taking into account the established qualification category and the volume of their teaching (pedagogical) work.

4. The main principles of certification are collegiality, publicity, openness, ensuring an objective attitude towards teaching staff, inadmissibility of discrimination during certification.

II. Certification of teaching staff in order to confirm compliance with the position held

5. Certification of teaching staff in order to confirm the compliance of teaching staff with their positions is carried out once every five years on the basis of an assessment of their professional activities by certification commissions, independently formed organizations (hereinafter referred to as the certification commission of the organization) 2 .

6. The attestation commission of the organization is created by the administrative act of the employer, consisting of the chairman of the commission, deputy chairman, secretary and members of the commission.

7. The composition of the attestation commission of the organization must include a representative of the elected body of the relevant primary trade union organization (if such a body exists).

8. Certification of teaching staff is carried out in accordance with the administrative act of the employer.

9. The employer introduces the teaching staff with the administrative act containing the list of employees of the organization subject to certification, the certification schedule, against signature at least 30 calendar days before the day of their certification according to the schedule.

10. To conduct certification for each teacher, the employer submits a submission to the certification commission of the organization.

11. The submission contains the following information about the teacher:

a) last name, first name, patronymic (if any);

b) the name of the position on the date of certification;

c) the date of conclusion of an employment contract for this position;

d) the level of education and (or) qualifications in the specialty or field of study;

e) information on obtaining additional professional education in the field of pedagogical activity;

f) the results of previous certifications (if any);

g) a motivated comprehensive and objective assessment of professional, business qualities, the results of the professional activity of a pedagogical worker in the performance of labor duties assigned to him by an employment contract.

12. The employer acquaints the teacher with the submission against signature no later than 30 calendar days before the day of the certification. After reviewing the submission, the teacher, if desired, may submit to the certification commission of the organization additional information characterizing his professional activities for the period from the date of the previous certification (for primary certification - from the date of employment).

If the teacher refuses to get acquainted with the presentation, an act is drawn up, which is signed by the employer and the persons (at least two) in whose presence the act is drawn up.

13. Certification is carried out at a meeting of the certification commission of the organization with the participation of a teacher.

The meeting of the attestation commission of the organization is considered competent if it is attended by at least two thirds of the total number of members of the attestation commission of the organization.

If a teacher is absent on the day of the certification at a meeting of the certification commission of the organization for good reasons, his certification is postponed to another date, and appropriate changes are made to the certification schedule, about which the employer informs the employee against signature at least 30 calendar days before the new date carrying out its certification.

If a teacher fails to appear at a meeting of the attestation commission of the organization without a good reason, the attestation commission of the organization conducts certification in his absence.

14. The attestation commission of the organization considers the submission, additional information submitted by the teacher himself, characterizing his professional activity (if any).

15. Based on the results of the certification of a teacher, the certification commission of the organization makes one of the following decisions:

corresponds to the position held (the position of the pedagogical worker is indicated);

does not correspond to the position held (the position of the pedagogical worker is indicated).

16. The decision is made by the attestation commission of the organization in the absence of the certified teacher by open voting by a majority vote of the members of the attestation commission of the organization present at the meeting.

When passing certification, a teacher who is a member of the certification commission of the organization does not participate in the voting on his candidacy.

17. In cases where at least half of the members of the attestation commission of the organization present at the meeting voted for the decision on the compliance of the employee with the position held, the teacher is recognized as appropriate for the position held.

18. The results of the attestation of a teacher who is directly present at a meeting of the attestation commission of the organization are communicated to him after summing up the voting results.

19. The results of the certification of teachers are recorded in a protocol signed by the chairman, deputy chairman, secretary and members of the certification commission of the organization who were present at the meeting, which is stored with submissions, additional information provided by the teachers themselves, characterizing their professional activities (if any) , at the employer.

20. For a teacher who has passed certification, no later than two working days from the date of its conduct by the secretary of the certification commission of the organization, an extract from the protocol is drawn up containing information about the last name, first name, patronymic (if any) of the person being certified, the name of his position, the date of the meeting of the certification commission of the organization , results of voting, on the decision adopted by the attestation commission of the organization. The employer acquaints the teacher with an extract from the protocol against signature within three working days after its preparation. An extract from the protocol is kept in the personal file of the teacher.

21. The results of certification in order to confirm the compliance of teachers with their positions on the basis of an assessment of their professional activities, a teacher has the right to appeal in accordance with the legislation of the Russian Federation.

22. Certification in order to confirm compliance with the position held does not pass the following teaching staff:

a) teaching staff with qualification categories;

b) who have worked in their position for less than two years in the organization in which certification is carried out;

c) pregnant women;

d) women on maternity leave;

e) persons on parental leave until the child reaches the age of three;

f) absent from the workplace for more than four consecutive months due to illness.

Certification of pedagogical workers, provided for in subparagraphs "d" and "e" of this paragraph, is possible no earlier than two years after their release from the specified holidays.

Certification of pedagogical workers, provided for by subparagraph "e" of this paragraph, is possible not earlier than one year after their entry into work.

23. Attestation commissions of organizations give recommendations to the employer on the possibility of appointing persons to the relevant positions of pedagogical workers who do not have special training or work experience established in the "Qualification Requirements" section of the "Qualification Characteristics of the Positions of Educational Workers" section of the Unified Qualification Directory for the positions of managers, specialists and employees and (or) professional standards, but having sufficient practical experience and competence, performing qualitatively and in full the duties assigned to them.

III. Certification of teaching staff in order to establish a qualification category

24. Certification of teaching staff in order to establish a qualification category is carried out at their request.

According to the results of certification, the first or highest qualification category is established for teaching staff.

25. Certification of pedagogical workers of organizations under the jurisdiction of federal executive bodies is carried out by attestation commissions formed by the federal executive authorities in whose jurisdiction these organizations are, and in relation to pedagogical workers of organizations under the jurisdiction of a constituent entity of the Russian Federation, pedagogical workers of municipal and private organizations, this attestation is carried out by attestation commissions formed by authorized state authorities of the constituent entities of the Russian Federation (hereinafter referred to as attestation commissions) 4 .

26. When forming attestation commissions, their composition, work regulations, as well as the conditions for attracting specialists to carry out a comprehensive analysis of the professional activities of teaching staff are determined.

The composition of the attestation commissions includes a representative of the relevant trade union.

27. Certification of teachers is carried out on the basis of their applications submitted directly to the certification commission, or sent by teachers to the certification commission by mail with a letter of receipt or notification in the form of an electronic document using public information and telecommunication networks, including number of the Internet.

28. In the application for certification, pedagogical workers indicate the qualification categories and positions for which they wish to be certified.

29. Applications for attestation are submitted by teaching staff, regardless of the length of work in the organization, including while on parental leave.

30. Applications for attestation in order to establish the highest qualification category for the position for which certification will be carried out for the first time are submitted by teachers no earlier than two years after the establishment of the first qualification category for this position.

31. The expiration of the highest qualification category does not limit the right of a teacher to subsequently apply to the certification commission with an application for his certification in order to establish the highest qualification category for the same position.

32. Applications of teachers for attestation are considered by attestation commissions within a period of not more than 30 calendar days from the date of their receipt, during which:

a) a specific term for the certification is determined for each teacher individually, taking into account the validity period of the previously established qualification category;

b) a written notification of teaching staff about the date and place of their certification is carried out.

33. The duration of certification for each teacher from the beginning of its implementation and until the decision of the certification commission is no more than 60 calendar days.

34. The meeting of the attestation commission is considered competent if it is attended by at least two thirds of the total number of its members.

35. The pedagogical worker has the right to personally be present during his certification at a meeting of the certification commission. If a teacher does not appear at a meeting of the attestation commission, attestation is carried out in his absence.

stable positive results in the development of educational programs by students based on the results of monitoring conducted by the organization;

stable positive results in the development of educational programs by students based on the results of monitoring the education system, carried out in the manner established by the Decree of the Government of the Russian Federation of August 5, 2013 N 662 5;

identifying the development of students' abilities for scientific (intellectual), creative, physical culture and sports activities;

personal contribution to improving the quality of education, improving the methods of training and education, broadcasting in teaching staff the experience of the practical results of their professional activities, active participation in the work of methodological associations of pedagogical workers of the organization.

achievement by students of positive dynamics of the results of mastering educational programs based on the results of monitoring conducted by the organization;

achievement by students of positive results in the development of educational programs based on the results of monitoring the education system, carried out in the manner established by the Decree of the Government of the Russian Federation of August 5, 2013 N 662 5;

identifying and developing students' abilities for scientific (intellectual), creative, physical culture and sports activities, as well as their participation in olympiads, competitions, festivals, competitions;

personal contribution to improving the quality of education, improving teaching and upbringing methods, and the productive use of new educational technologies, broadcasting experience in the teaching staff of the practical results of their professional activities, including experimental and innovative;

active participation in the work of methodological associations of pedagogical workers of organizations, in the development of program and methodological support of the educational process, professional competitions.

38. Evaluation of the professional activities of teachers in order to establish a qualification category is carried out by the certification commission based on the results of their work, provided for in paragraphs 36 and 37 of this Procedure, provided that their activities are related to the relevant areas of work.

39. Based on the results of certification, the certification commission makes one of the following decisions:

establish the first (highest) qualification category (the position of the pedagogical worker for which the qualification category is established is indicated);

refuse to establish the first (highest) qualification category (the position for which the teacher is denied the establishment of a qualification category is indicated).

40. The decision of the attestation commission is made in the absence of the attested teacher by open voting by a majority vote of the members of the attestation commission present at the meeting. In case of equality of votes, the attestation commission makes a decision to establish the first (highest) qualification category.

When passing the attestation, a teacher who is a member of the attestation commission does not participate in the voting on his candidacy.

The results of the attestation of a teacher directly present at a meeting of the attestation commission are communicated to him after summing up the voting results.

41. The decision of the attestation commission is drawn up in a protocol, which is signed by the chairman, deputy chairman, secretary and members of the attestation commission who took part in the voting.

The decision of the attestation commission comes into force from the date of its issuance.

42. When making a decision of the attestation commission to refuse to establish the highest qualification category in relation to a teacher who has the first qualification category, the first qualification category is retained for him until its expiration.

43. Pedagogical workers who, during certification, were denied the establishment of a qualification category, apply at their request to the certification commission with an application for certification for the same qualification category not earlier than one year from the date the certification commission made the appropriate decision.

44. Based on the decisions of the attestation commissions on the results of attestation of pedagogical workers, the relevant federal executive authorities or authorized state authorities of the constituent entities of the Russian Federation issue administrative acts on the establishment of pedagogical workers of the first or highest qualification category from the date of the decision of the attestation commission, which are posted on the official websites of the indicated bodies on the Internet.

45. The results of certification in order to establish a qualification category (first or highest), a teacher has the right to appeal in accordance with the legislation of the Russian Federation.

46. ​​The qualification categories established for teaching staff are retained until the expiration of their validity upon transfer to another organization, including one located in another subject of the Russian Federation.

Establish that the qualification categories assigned to pedagogical and executive employees of state and municipal educational institutions before the entry into force of the Procedure for attestation of pedagogical workers of state and municipal educational institutions are retained for the period for which they were assigned.

3. To introduce the Procedure for attestation of teaching staff of state and municipal educational institutions from January 1, 2011.

4. Recognize invalid from January 1, 2011 the order of the Ministry of Education of the Russian Federation dated June 26, 2000 N 1908 "On approval of the Regulations on the procedure for attestation of pedagogical and executive employees of state and municipal educational institutions" (registered by the Ministry of Justice of the Russian Federation on July 24, 2000, registration N 2322; Bulletin of normative acts of federal executive bodies, 2000, N 32).

Appendix

I. General provisions

1. This Procedure for the certification of teachers of state and municipal educational institutions (hereinafter referred to as the Procedure) determines the rules for attestation of teachers of state and municipal educational institutions implementing the main educational programs of preschool, primary general, basic general, secondary (complete) general education, primary vocational and secondary vocational education, as well as additional educational programs (hereinafter, respectively, - pedagogical workers, educational institutions, educational programs).

Pedagogical workers include persons holding positions assigned to the professional qualification group of positions of pedagogical workers, approved by order of the Ministry of Health and Social Development of the Russian Federation of May 5, 2008 N 216n "On approval of professional qualification groups of positions of educators" (registered by the Ministry of Justice of the Russian Federation May 22, 2008, registration N 11731; Rossiyskaya Gazeta, 2008, N 113).

Certification of employees holding positions of scientific and pedagogical workers is carried out in accordance with the Regulations on the procedure for attestation of employees holding positions of scientific and pedagogical workers, approved by order of the Ministry of Education and Science of the Russian Federation dated August 6, 2009 N 284 "On approval of the Regulations on the procedure for conducting certification of employees holding positions of scientific and pedagogical workers" (registered by the Ministry of Justice of the Russian Federation on September 15, 2009, registration N 14772, Bulletin of normative acts of federal executive bodies, 2009, N 40).

2. Attestation is carried out in order to establish the compliance of the level of qualification of teaching staff with the requirements for qualification categories (first or highest), or to confirm the compliance of teaching staff with their positions based on an assessment of their professional activities.

3. The main objectives of certification are:

stimulation of purposeful, continuous improvement of the level of qualification of pedagogical workers, their methodological culture, personal professional growth, their use of modern pedagogical technologies;

improving the efficiency and quality of pedagogical work;

identifying prospects for using the potential of teaching staff;

taking into account the requirements of federal state educational standards for personnel conditions for the implementation of educational programs when forming the personnel of educational institutions;

determining the need for advanced training of teaching staff;

ensuring differentiation of the level of remuneration of teachers.

4. The main principles of certification are collegiality, publicity, openness, ensuring an objective attitude towards teaching staff, inadmissibility of discrimination during certification.

II. Formation of attestation commissions, their composition and work procedure

5. Attestation of pedagogical workers of educational institutions of the constituent entity of the Russian Federation and municipal educational institutions is carried out by an attestation commission formed by the executive authority of the constituent entity of the Russian Federation that manages in the field of education; certification of pedagogical workers of federal state educational institutions - by an attestation commission formed by the federal executive authorities in whose jurisdiction they are (hereinafter referred to as the federal executive authorities).

6. The attestation commission, consisting of the chairman of the commission, deputy chairman, secretary and members of the commission, is formed from among representatives of federal state authorities, state authorities of the constituent entities of the Russian Federation, local governments, trade unions, scientific organizations and public associations, self-government bodies of educational institutions ( councils of educational institutions, boards of trustees, pedagogical councils, etc.) and employees of educational institutions.

The personal composition of the attestation commission is approved by the administrative act of the federal executive body, the executive body of the constituent entity of the Russian Federation that manages education.

In order to conduct certification in order to confirm the compliance of a teacher with the position held, the certification commission must include a representative of the elected body of the relevant primary trade union organization of the educational institution in which this teacher works (another trade union representative authorized by the primary trade union organization of the educational institution).

7. In order to conduct certification in order to establish the compliance of the qualification level of a teacher with the requirements for qualification categories (first or highest), the certification commission creates expert groups to carry out a comprehensive analysis of the results of the professional activity of a teacher and prepare an appropriate expert opinion for the certification commission.

8. The composition of the attestation commission and expert groups is formed in such a way that the possibility of a conflict of interest that could affect the decisions made by the attestation commissions is excluded.

9. The meeting of the attestation commission is considered competent if at least two thirds of its members are present at it.

10. The pedagogical worker has the right to personally be present during his attestation at a meeting of the attestation commission, of which he notifies the attestation commission in writing. If a teacher fails to appear at a meeting of the attestation commission without a good reason, the commission has the right to conduct attestation in his absence.

11. The decision of the attestation commission is made in the absence of the attested teacher by open voting by a majority vote of the members of the attestation commission present at the meeting. With an equal number of votes of the members of the attestation commission, it is considered that the teacher has passed the attestation.

When passing the attestation, a teacher who is a member of the attestation commission does not participate in the voting on his candidacy.

The results of the attestation of a teacher directly present at a meeting of the attestation commission are communicated to him after summing up the voting results.

12. The work schedules of the attestation commissions are approved annually by an administrative act of the federal executive body, the executive body of the constituent entity of the Russian Federation that manages education.

13. The decision of the attestation commission is drawn up in a protocol that comes into force from the date of signing by the chairman, deputy chairman, secretary and members of the attestation commission who took part in the vote, and is entered in the attestation sheet of the teacher.

If necessary, the attestation commission enters recommendations on improving the professional activities of a pedagogical worker, on the need to improve his qualifications, indicating specialization and other recommendations, in the certification sheet of a pedagogical worker, if necessary.

If the certification sheet contains these recommendations, the employer, no later than one year from the date of the certification of the teacher, submits to the certification commission information on the implementation of the recommendations of the certification commission to improve the professional activities of the teacher.

14. The decision of the attestation commission on the results of attestation of pedagogical workers is approved by the administrative act of the federal executive body, the executive body of the constituent entity of the Russian Federation that manages education. For teaching staff, in respect of which the attestation commission has made a decision on the compliance of their qualification level with the requirements for the first (highest) qualification category, the corresponding qualification category is established by the specified administrative act.

15. The attestation sheet and an extract from the administrative act of the federal executive body, the executive body of the constituent entity of the Russian Federation exercising management in the field of education, are sent to the employer of the pedagogical worker no later than 30 calendar days from the date of the decision of the attestation commission to familiarize the employee with them under painting and decision making in accordance with the Labor Code of the Russian Federation.

The attestation sheet, an extract from the administrative act of the federal executive body, the executive body of the constituent entity of the Russian Federation that manages the field of education, are stored in the personal file of the pedagogical worker.

16. A teacher has the right to appeal against the results of certification in accordance with the legislation of the Russian Federation.

III. The procedure for certification of teaching staff in order to confirm compliance with the position held

17. Certification in order to confirm the compliance of teaching staff with their position is carried out once every 5 years in relation to teaching staff who do not have qualification categories (first or highest).

18. Certification is not subject to:

teachers who have worked in their position for less than two years;

pregnant women; women on maternity leave; pedagogical workers who are on parental leave until the child reaches the age of three years. Certification of these employees is possible not earlier than two years after their release from the specified holidays.

19. The basis for certification is the presentation of the employer (hereinafter referred to as the presentation).

20. The submission must contain a motivated comprehensive and objective assessment of the professional, business qualities of a teacher, the results of his professional activity on the basis of the qualification characteristics for the position held, information about the passage of advanced training by the teacher, including in the direction of the employer, for the period preceding certification, information about the results of previous certifications.

The teacher must be familiarized with the submission by the employer against signature no later than one month before the day of the certification. After reviewing the submission, the pedagogical worker has the right to submit to the certification commission his own information characterizing his labor activity for the period from the date of the previous certification (for initial certification - from the date of employment), as well as a statement with appropriate justification in case of disagreement with the presentation of the employer.

21. Information about the date, place and time of the certification is communicated in writing by the employer to the teaching staff subject to certification, no later than a month before it starts.

22. In the course of attestation, teaching staff undergo qualification tests in writing on issues related to the implementation of their pedagogical activities in their position.

23. Based on the results of the certification of a teacher in order to confirm the suitability of the position held, the certification commission takes one of the following decisions:

corresponds to the position held (the position of the employee is indicated);

does not correspond to the position held (the position of the employee is indicated).

24. If a teacher is recognized, according to the results of certification, as inappropriate for the position held due to insufficient qualifications, the employment contract with him may be terminated in accordance with clause 3 of part 1 of article 81 of the Labor Code of the Russian Federation. Dismissal on this basis is allowed if it is impossible to transfer a teacher with his written consent to another job available to the employer (both a vacant position or a job corresponding to the qualifications of the employee, and a vacant lower position or lower-paid job), which the employee can perform taking into account his condition health (Part 3 of Article 81 of the Labor Code of the Russian Federation).

IV. The procedure for certification of teaching staff to establish the compliance of the level of their qualifications with the requirements for qualification categories (first or highest)

25. Certification of a pedagogical worker to establish the compliance of the level of his qualifications with the requirements for the first or highest qualification categories is carried out on the basis of an application from a teaching worker.

The application of a teacher for attestation must be considered by the attestation commission no later than one month from the date of submission.

26. The timing of certification for each teacher is set by the certification commission individually in accordance with the schedule. When drawing up the schedule, the duration of the previously established qualification categories should be taken into account.

27. The duration of the certification for each teacher from the beginning of its implementation and until the decision of the certification commission should not exceed two months.

28. The qualification category established on the basis of attestation for teaching staff is valid for five years.

29. Pedagogical workers can apply to the attestation commission with an application for attestation to establish the compliance of their qualification level with the requirements for the highest qualification category, not earlier than 2 years after the establishment of the first qualification category.

30. The first qualification category can be established for teaching staff who:



make a personal contribution to improving the quality of education through the improvement of teaching and upbringing methods;

have stable results in the development of educational programs by students, pupils and indicators of the dynamics of their achievements above the average in the subject of the Russian Federation.

31. The highest qualification category can be established for teaching staff who:

have the established first qualification category;

own modern educational technologies and methods and effectively apply them in practical professional activities;

have stable results in the development of educational programs by students, pupils and indicators of the dynamics of their achievements above average in the subject of the Russian Federation, including taking into account the results of the participation of students and pupils in All-Russian, international Olympiads, competitions, competitions;

make a personal contribution to improving the quality of education through the improvement of methods of education and upbringing, innovation, in the development of new educational technologies and actively disseminate their own experience in the field of improving the quality of education and upbringing.

32. Based on the results of certification, the certification commission makes one of the following decisions:

a) the level of qualification (position is indicated) meets the requirements for the first (highest) qualification category;

b) the level of qualification (position is indicated) does not meet the requirements for the first (highest) qualification category.

33. When making a decision of the attestation commission on the non-compliance of the qualification level of a teacher with the requirements for the highest qualification category, he retains the first qualification category until the expiration of its validity.

34. Qualification categories are retained when a teacher transfers to another educational institution, including one located in another subject of the Russian Federation, during the term of its validity.

3. Appendix

I. General provisions

1. The procedure for attestation of pedagogical workers of organizations engaged in educational activities (hereinafter referred to as the organization) determines the rules, main tasks and principles for attestation of pedagogical workers of organizations.

This Procedure applies to teaching staff of organizations filling positions named in subsection 2 of section I of the nomenclature of positions of teaching staff of organizations engaged in educational activities, positions of heads of educational organizations, approved by Decree of the Government of the Russian Federation of August 8, 2013 N 678 (Collection of Legislation of the Russian Federation, 2013, N 33, Art. 4381), including in cases where the filling of positions is carried out part-time in the same or another organization, as well as by combining positions along with work in the same organization, defined by an employment contract (hereinafter referred to as teaching staff ).

2. Certification of teaching staff is carried out in order to confirm the compliance of teaching staff with their positions based on an assessment of their professional activities and at the request of teaching staff (with the exception of teaching staff from among the teaching staff) in order to establish a qualification category.

3. The main tasks of certification are:

stimulation of purposeful, continuous improvement of the level of qualification of pedagogical workers, their methodological culture, professional and personal growth;

determining the need for advanced training of teaching staff;

improving the efficiency and quality of teaching activities;

identifying prospects for using the potential of teaching staff;

taking into account the requirements of federal state educational standards for personnel conditions for the implementation of educational programs when forming the personnel of organizations;

ensuring the differentiation of wages for teachers, taking into account the established qualification category and the volume of their teaching (pedagogical) work.

4. The main principles of certification are collegiality, publicity, openness, ensuring an objective attitude towards teaching staff, inadmissibility of discrimination during certification.

II. Certification of teaching staff in order to confirm compliance with the position held

5. Certification of teaching staff in order to confirm the compliance of teaching staff with their positions is carried out once every five years on the basis of an assessment of their professional activities by certification commissions, independently formed organizations (hereinafter referred to as the certification commission of the organization).

6. The attestation commission of the organization is created by the administrative act of the employer, consisting of the chairman of the commission, deputy chairman, secretary and members of the commission.

7. The composition of the attestation commission of the organization must include a representative of the elected body of the relevant primary trade union organization (if such a body exists).

8. Certification of teaching staff is carried out in accordance with the administrative act of the employer.

9. The employer introduces the teaching staff with the administrative act containing the list of employees of the organization subject to certification, the certification schedule, against signature at least 30 calendar days before the day of their certification according to the schedule.

10. To conduct certification for each teacher, the employer submits a submission to the certification commission of the organization.

11. The submission contains the following information about the teacher:

a) last name, first name, patronymic (if any);

b) the name of the position on the date of certification;

c) the date of conclusion of an employment contract for this position;

d) the level of education and (or) qualifications in the specialty or field of study;

e) information on obtaining additional professional education in the field of pedagogical activity;

f) the results of previous certifications (if any);

g) a motivated comprehensive and objective assessment of professional, business qualities, the results of the professional activity of a pedagogical worker in the performance of labor duties assigned to him by an employment contract.

12. The employer acquaints the teacher with the submission against signature no later than 30 calendar days before the day of the certification. After reviewing the submission, the teacher, if desired, may submit to the certification commission of the organization additional information characterizing his professional activities for the period from the date of the previous certification (for primary certification - from the date of employment).

If the teacher refuses to get acquainted with the presentation, an act is drawn up, which is signed by the employer and the persons (at least two) in whose presence the act is drawn up.

13. Certification is carried out at a meeting of the certification commission of the organization with the participation of a teacher.

The meeting of the attestation commission of the organization is considered competent if it is attended by at least two thirds of the total number of members of the attestation commission of the organization.

If a teacher is absent on the day of the certification at a meeting of the certification commission of the organization for good reasons, his certification is postponed to another date, and appropriate changes are made to the certification schedule, about which the employer informs the employee against signature at least 30 calendar days before the new date carrying out its certification.

If a teacher fails to appear at a meeting of the attestation commission of the organization without a good reason, the attestation commission of the organization conducts certification in his absence.

14. The attestation commission of the organization considers the submission, additional information submitted by the teacher himself, characterizing his professional activity (if any).

15. Based on the results of the certification of a teacher, the certification commission of the organization makes one of the following decisions:

corresponds to the position held (the position of the pedagogical worker is indicated);

does not correspond to the position held (the position of the pedagogical worker is indicated).

16. The decision is made by the attestation commission of the organization in the absence of the certified teacher by open voting by a majority vote of the members of the attestation commission of the organization present at the meeting.

When passing certification, a teacher who is a member of the certification commission of the organization does not participate in the voting on his candidacy.

17. In cases where at least half of the members of the attestation commission of the organization present at the meeting voted for the decision on the compliance of the employee with the position held, the teacher is recognized as appropriate for the position held.

18. The results of the attestation of a teacher who is directly present at a meeting of the attestation commission of the organization are communicated to him after summing up the voting results.

19. The results of the certification of teachers are recorded in a protocol signed by the chairman, deputy chairman, secretary and members of the certification commission of the organization who were present at the meeting, which is stored with submissions, additional information provided by the teachers themselves, characterizing their professional activities (if any) , at the employer.

20. For a teacher who has passed certification, no later than two working days from the date of its conduct by the secretary of the certification commission of the organization, an extract from the protocol is drawn up containing information about the last name, first name, patronymic (if any) of the person being certified, the name of his position, the date of the meeting of the certification commission of the organization , results of voting, on the decision adopted by the attestation commission of the organization. The employer acquaints the teacher with an extract from the protocol against signature within three working days after its preparation. An extract from the protocol is kept in the personal file of the teacher.

21. The results of certification in order to confirm the compliance of teachers with their positions on the basis of an assessment of their professional activities, a teacher has the right to appeal in accordance with the legislation of the Russian Federation.

22. Certification in order to confirm compliance with the position held does not pass the following teaching staff:

a) teaching staff with qualification categories;

b) who have worked in their position for less than two years in the organization in which certification is carried out;

c) pregnant women;

d) women on maternity leave;

e) persons on parental leave until the child reaches the age of three;

f) absent from the workplace for more than four consecutive months due to illness.

Certification of pedagogical workers, provided for in subparagraphs "d" and "e" of this paragraph, is possible no earlier than two years after their release from the specified holidays.

Certification of pedagogical workers, provided for by subparagraph "e" of this paragraph, is possible not earlier than one year after their entry into work.

23. Attestation commissions of organizations give recommendations to the employer on the possibility of appointing persons to the relevant positions of pedagogical workers who do not have special training or work experience established in the "Qualification Requirements" section of the "Qualification Characteristics of the Positions of Educational Workers" section of the Unified Qualification Directory for the positions of managers, specialists and employees and (or) professional standards, but having sufficient practical experience and competence, performing qualitatively and in full the duties assigned to them.

III. Certification of teaching staff in order to establish a qualification category

24. Certification of teaching staff in order to establish a qualification category is carried out at their request.

According to the results of certification, the first or highest qualification category is established for teaching staff.

The qualification category is established for a period of 5 years. The validity period of the qualification category is not subject to extension.

25. Certification of pedagogical workers of organizations under the jurisdiction of federal executive bodies is carried out by attestation commissions formed by the federal executive authorities in whose jurisdiction these organizations are, and in relation to pedagogical workers of organizations under the jurisdiction of a constituent entity of the Russian Federation, pedagogical workers of municipal and private organizations, this attestation is carried out by attestation commissions formed by authorized state authorities of the constituent entities of the Russian Federation (hereinafter referred to as attestation commissions).

26. When forming attestation commissions, their composition, work regulations, as well as the conditions for attracting specialists to carry out a comprehensive analysis of the professional activities of teaching staff are determined.

The composition of the attestation commissions includes a representative of the relevant trade union.

27. Certification of teachers is carried out on the basis of their applications submitted directly to the certification commission, or sent by teachers to the certification commission by mail with a letter of receipt or notification in the form of an electronic document using public information and telecommunication networks, including number of the Internet.

28. In the application for certification, pedagogical workers indicate the qualification categories and positions for which they wish to be certified.

29. Applications for attestation are submitted by teaching staff, regardless of the length of work in the organization, including while on parental leave.

30. Applications for attestation in order to establish the highest qualification category for the position for which certification will be carried out for the first time are submitted by teachers no earlier than two years after the establishment of the first qualification category for this position.

31. The expiration of the highest qualification category does not limit the right of a teacher to subsequently apply to the certification commission with an application for his certification in order to establish the highest qualification category for the same position.

32. Applications of teachers for attestation are considered by attestation commissions within a period of not more than 30 calendar days from the date of their receipt, during which:

a) a specific term for the certification is determined for each teacher individually, taking into account the validity period of the previously established qualification category;

b) a written notification of teaching staff about the date and place of their certification is carried out.

33. The duration of certification for each teacher from the beginning of its implementation and until the decision of the certification commission is no more than 60 calendar days.

34. The meeting of the attestation commission is considered competent if it is attended by at least two thirds of the total number of its members.

35. The pedagogical worker has the right to personally be present during his certification at a meeting of the certification commission. If a teacher does not appear at a meeting of the attestation commission, attestation is carried out in his absence.

36. The first qualification category for teaching staff is established on the basis of:

stable positive results in the development of educational programs by students based on the results of monitoring conducted by the organization;

stable positive results in the development of educational programs by students based on the results of monitoring the education system, carried out in the manner prescribed;

identifying the development of students' abilities for scientific (intellectual), creative, physical culture and sports activities;

personal contribution to improving the quality of education, improving the methods of training and education, broadcasting in teaching staff the experience of the practical results of their professional activities, active participation in the work of methodological associations of pedagogical workers of the organization.

37. The highest qualification category for teaching staff is established on the basis of:

achievement by students of positive dynamics of the results of mastering educational programs based on the results of monitoring conducted by the organization;

achievement by students of positive results in the development of educational programs based on the results of monitoring the education system conducted in the manner established by the Decree of the Government of the Russian Federation of August 5, 2013 N 662;

identifying and developing students' abilities for scientific (intellectual), creative, physical culture and sports activities, as well as their participation in olympiads, competitions, festivals, competitions;

personal contribution to improving the quality of education, improving teaching and upbringing methods, and the productive use of new educational technologies, broadcasting experience in the teaching staff of the practical results of their professional activities, including experimental and innovative;

active participation in the work of methodological associations of pedagogical workers of organizations, in the development of program and methodological support of the educational process, professional competitions.

38. Evaluation of the professional activities of teachers in order to establish a qualification category is carried out by the certification commission based on the results of their work, provided for in paragraphs 36 and 37 of this Procedure, provided that their activities are related to the relevant areas of work.

39. Based on the results of certification, the certification commission makes one of the following decisions:

establish the first (highest) qualification category (the position of the pedagogical worker for which the qualification category is established is indicated);

refuse to establish the first (highest) qualification category (the position for which the teacher is denied the establishment of a qualification category is indicated).

40. The decision of the attestation commission is made in the absence of the attested teacher by open voting by a majority vote of the members of the attestation commission present at the meeting. In case of equality of votes, the attestation commission makes a decision to establish the first (highest) qualification category.

When passing the attestation, a teacher who is a member of the attestation commission does not participate in the voting on his candidacy.

The results of the attestation of a teacher directly present at a meeting of the attestation commission are communicated to him after summing up the voting results.

41. The decision of the attestation commission is drawn up in a protocol, which is signed by the chairman, deputy chairman, secretary and members of the attestation commission who took part in the voting.

The decision of the attestation commission comes into force from the date of its issuance.

42. When making a decision of the attestation commission to refuse to establish the highest qualification category in relation to a teacher who has the first qualification category, the first qualification category is retained for him until its expiration.

43. Pedagogical workers who, during certification, were denied the establishment of a qualification category, apply at their request to the certification commission with an application for certification for the same qualification category not earlier than one year from the date the certification commission made the appropriate decision.

44. Based on the decisions of the attestation commissions on the results of attestation of pedagogical workers, the relevant federal executive authorities or authorized state authorities of the constituent entities of the Russian Federation issue administrative acts on the establishment of pedagogical workers of the first or highest qualification category from the date of the decision of the attestation commission, which are posted on the official websites of the indicated bodies on the Internet.

45. The results of certification in order to establish a qualification category (first or highest), a teacher has the right to appeal in accordance with the legislation of the Russian Federation.

46. ​​The qualification categories established for teaching staff are retained until the expiration of their validity upon transfer to another organization, including one located in another subject of the Russian Federation.

Labor legislation provides for the certification of an employee in order to establish his compliance (non-compliance) with the position held (work performed) . The procedure for conducting attestation is established by regulatory legal acts containing labor law norms, or local regulations in force at the employer. Such normative acts reflect the features of the certification of employees, taking into account the specifics of labor activity and the conditions for its implementation. The latter fully applies to the certification of teaching staff of organizations engaged in educational activities.

In accordance with Federal Law No. 273-FZ of December 29, 2012 “On Education in the Russian Federation” (as amended on July 21, 2014; hereinafter referred to as Federal Law No. 273-FZ), pedagogical workers are certified for compliance with their position and in order to establish them qualification category. Order of the Ministry of Education and Science of the Russian Federation No. 276 dated April 7, 2014 (hereinafter - Order No. 276) approved a new Procedure for the certification of teaching staff of organizations engaged in educational activities (hereinafter - the Procedure), which determines the general requirements for certification, as well as the features of its carrying out for the purposes of confirming the conformity of the teaching worker to the position held and for the purposes of establishing a qualification category for the teaching worker.

The procedure applies to the attestation of teaching staff filling positions named in subsection 2 of section I of the nomenclature of positions of heads and teaching staff of educational organizations (approved by Decree of the Government of the Russian Federation dated 08.08. activities, positions of heads of educational organizations"), including in cases where positions are filled in combination in the same or another organization, as well as by combining positions along with work in the same organization, defined by an employment contract (paragraph 2, clause 1 of section 1 order).

According to paragraph 3 of section 1 of the Procedure the main tasks of certification are:

  • stimulation of purposeful, continuous improvement of the level of qualification of pedagogical workers, their methodological culture, professional and personal growth;
  • determining the need for advanced training of teaching staff;
  • improving the efficiency and quality of teaching activities;
  • identifying prospects for using the potential of teaching staff;
  • taking into account the requirements of federal state educational standards for personnel conditions for the implementation of educational programs when forming the personnel of organizations;
  • ensuring the differentiation of wages for teachers, taking into account the established qualification category and the volume of their teaching (pedagogical) work.

Basic principles attestation: collegiality, publicity, openness, ensuring an objective attitude towards teaching staff, inadmissibility of discrimination during attestation (clause 4, section I of the Order).

Certification in order to confirm the compliance of a teacher with a position held is mandatory for the latter and is carried out, with some exceptions, every five years, and certification in order to establish a qualification category for a teacher, on the contrary, is carried out at the request of the relevant employee (see Parts 1-2 of Art. 49 of Federal Law No. 273, paragraph 5 of Section II and paragraph 24 of Section III of the Order).

In order to confirm the suitability of the position The following teachers do not pass certification(clause 22 of section II of the Order):

  • having qualification categories;
  • who have worked in their position for less than two years in the organization in which certification is carried out;
  • pregnant women;
  • women on maternity leave;
  • persons on parental leave until the child reaches the age of three;
  • absent from the workplace for more than four consecutive months due to illness.

Note:

Conducting certification of pedagogical workers, provided for in subparagraphs "d" and "e", is allowed no earlier than two years after their release from the specified holidays. Certification of pedagogical workers, provided for in subparagraph “e”, is allowed no earlier than one year after their entry into work.

The local regulations in force at the employer may define other categories of pedagogical workers, whose certification is organized at a time different from those provided for by Order No. 276, for example, persons on leave in connection with the adoption of a child (Article 257 of the Labor Code of the Russian Federation), persons those on long-term leave (subclause 4, clause 5, article 47 of Federal Law No. 273), etc.

Features of certification carried out in order to confirm the compliance of the teacher with the position held

For certification in an educational organization, a special certifying commission. An order (instruction) is issued on its formation by the employer, which approves the personal composition of the certification commission: chairman, deputy chairman, secretary and members of the commission) and, if necessary, the regulation on the commission, the rules of work of the commission, etc.

Also, the Employer issues an appropriate order (instruction) on the certification, which determines the personal composition of the teaching staff subject to certification, the certification schedule, if necessary, other issues on the organization of certification events.

Not less than 30 days before the date stipulated by the certification schedule, each teacher subject to certification must be familiarized with the order (instruction) against signature. For every teacher, the employer submits to the certification commission in advance representation containing information about the teacher:

  • surname, name, patronymic (if any);
  • the name of the position on the date of certification;
  • date of conclusion of an employment contract for this position;
  • level of education and (or) qualifications in the specialty or field of study;
  • information on obtaining additional professional education in the field of pedagogical activity;
  • results of previous certifications (if any);
  • a motivated comprehensive and objective assessment of professional, business qualities, the results of the professional activity of a teacher in the performance of labor duties assigned to him by an employment contract (clause 11, section II of the Order).

Not later than 30 days before the scheduled date of certification the employer is obliged to acquaint the teacher with the submission against signature. After reviewing the submission, the teacher, at his own request, may submit to the certification commission additional information characterizing his professional activities for the period from the date of the previous certification (for primary certification - from the date of entry to work) (clause 12 of section II of the Order). In the event that the employee refuses to familiarize himself with the presentation, the employer draws up and signs an appropriate act in the presence of at least two persons.

The main form of attestation is a meeting of the attestation commission, which is considered competent in the presence of at least two thirds of the total number of members of the attestation commission. The teaching staff subject to certification must be present at the meeting. In case of absence for a good reason (must be documented and reflected in the minutes of the meeting), his certification is postponed to another date, and changes are made to the schedule, with which the employee must be familiarized at least 30 calendar days before the date of the new certification. In case of non-appearance of a pedagogical worker without a valid reason, the certification commission of the organization has the right to conduct certification in his absence.

During the meeting, the attestation commission considers the presentation and (if any) additional information characterizing the professional activity of the person being certified.

If this is provided for by the regulations of the attestation commission, the members of the attestation commission exchange opinions, ask questions both to each other and to the certified teacher, if necessary, make motivated proposals for considering additional information, etc.

Based on the results of consideration of the available information, the attestation commission makes one of the following decisions (indicating in the minutes of the meeting the position of the attested teacher):

  • corresponds to the position held (when at least half of the members of the attestation commission present voted for the decision on the compliance of the person being attested with the position held);
  • does not match the position.

“The decision is made by the attestation commission of the organization in the absence of the certified teacher by open voting by a majority vote of the members of the attestation commission of the organization present at the meeting.

When passing the certification, a teacher who is a member of the certification commission of the organization does not participate in the voting on his candidacy ”(clause 16 of section II of the Procedure).

The results of certification of pedagogical workers are entered in protocol, signed by all members of the attestation commission and communicated to the person being certified immediately after the voting results are summed up. The protocol, along with other documents related to the certification of teaching staff, is kept by the employer. According to paragraph 20 of section II of the Procedure for a teacher who has passed certification, no later than two working days from the date of its conduct, the secretary of the certification commission of the organization draws up an extract from the protocol containing information about the last name, first name, patronymic (if any) of the person being certified, the name of his position, the date of the meeting of the attestation commission of the organization, the results of voting, on the decision adopted by the attestation commission of the organization. The employer acquaints the teacher with an extract from the protocol against signature within three working days after its preparation. An extract from the protocol is kept in the personal file of the teacher.

The results of certification in order to confirm the compliance of teachers with their positions based on the assessment and professional activities of a teacher entitled to appeal in accordance with the legislation of the Russian Federation (clause 21 of section II of the Order).

The results of the attestation are the basis for the attestation commission to submit for consideration by the employer motivated recommendations on the advisability (inappropriateness) of appointing persons to the relevant positions of pedagogical workers who do not have special training and (and) work experience, but at the same time have sufficient practical experience and competence, performing the tasks assigned to them. their official duties qualitatively and in full (clause 23 of section II of the Order).

Features of certification conducted in order to establish a qualification category for a teacher

Certification in order to establish a qualification category for a teacher is also carried out by a specially authorized body - an attestation commission. But in this case, the commission is formed not by the employer (educational organization), but federal executive bodies or authorized state authorities of the constituent entities of the Russian Federation. It all depends on who is in charge of the relevant educational organizations (clause 25 of section III of the Order). The principles for the formation of attestation commissions are almost identical to those for conducting attestations in order to confirm compliance with the position held. In this case, the conditions for attracting specialists to carry out a comprehensive analysis of the professional activities of pedagogical workers are still being determined (clause 26 of section III of the Order).

As noted, this type of certification is declarative character- it is carried out on the basis of a written application of a teacher applying for the assignment of a qualification category, which is submitted directly to the authorized attestation commission. The employee may also send the application by regular mail (letter with acknowledgment of receipt) or by e-mail (with notification in the form of an electronic document). The application indicates the qualification categories and positions for which the teacher wishes to undergo certification (clauses 27, 28, section III of the Order).

“Application for certification in order to establish the highest qualification category for the position for which certification will be carried out for the first time is submitted by a teacher not earlier than two years later after the establishment of the first qualification category for this position. The expiration of the highest qualification category does not restrict the right of a teacher to subsequently apply to the certification commission with an application for certification in order to establish the highest qualification category for the same position. Applications of pedagogical workers for attestation are considered by authorized attestation commissions on time no more than 30 calendar days from the date of receipt, during which:

a) a specific term for the certification is determined for each teacher individually, taking into account the validity period of the previously established qualification category;

b) a written notification of teaching staff about the date and place of their certification is carried out ”(paragraphs 30 - 32 of section III of the order).

The duration of the certification for each teacher from the beginning of its implementation and until the decision of the certification commission cannot exceed 60 calendar days (clause 33 of section III of the Order).

In the light of the topic under consideration, let us pay attention to the basic criteria for establishing the first and highest qualification categories for teaching staff (clauses 36, 37 of section III of the Order).

  • stable positive results in the development of educational programs by students based on the results of monitoring conducted by the organization;
  • stable positive results in the development of educational programs by students based on the results of monitoring the education system, carried out in the manner established by the Decree of the Government of the Russian Federation dated August 05, 2013 No. 662 “On monitoring the education system”;
  • identifying the development of students' abilities for scientific (intellectual), creative, physical culture and sports activities;
  • personal contribution to improving the quality of education, improving the methods of training and education, broadcasting in teaching staff the experience of the practical results of their professional activities, active participation in the work of methodological associations of pedagogical workers of the organization.
  • achievement by students of positive dynamics of the results of mastering educational programs based on the results of monitoring conducted by the organization;
  • achievement by students of positive results in the development of educational programs based on the results of monitoring the education system, carried out in the manner established by the Decree of the Government of the Russian Federation dated August 05, 2013 No. 662 “On monitoring the education system”;
  • identifying and developing students' abilities for scientific (intellectual), creative, physical culture and sports activities, as well as their participation in olympiads, competitions, festivals, competitions;
  • personal contribution to improving the quality of education, improving teaching and upbringing methods and the productive use of new educational technologies, broadcasting experience in the teaching staff of the practical results of their professional activities, including experimental and innovative;
  • active participation in the work of methodological associations of pedagogical workers of organizations, in the development of program and methodological support of the educational process, professional competitions.

According to clause 35 of section III of the Procedure, certification in order to establish a qualification category for a teacher can be carried out both in the presence of the person being certified, and without him, regardless of the reasons for the absence.

The assessment of the professional activity of pedagogical workers in order to establish a qualification category is carried out by the certification commission based on the results of their work (according to the criteria for establishing the corresponding category), provided that their professional activity is actually related to the relevant areas of work (clause 38, section III of the Order).

Based on the results of the attestation, the attestation commission makes one of the following decisions (indicating the position of the attested teacher):

  • establish the first (highest) qualification category;
  • refuse to establish the first (highest) qualification category.

Final stage carrying out attestation (up to the possibility of appeal by the person being certified against its results) the same as in the case of attestation in order to confirm compliance with the position held.

True, unlike the first type of certification, in this case, the results of the certification are made public: “based on the decisions of the certification commissions on the results of the certification of teachers, the relevant federal executive authorities or authorized state authorities of the constituent entities of the Russian Federation issue administrative acts on establishing the first or the highest qualification category from the date of the decision by the certification commission, which are posted on the official websites of these bodies on the Internet (clause 44 of section III of the Order).

A new procedure for attestation of teaching staff of educational organizations has been established. It does not apply to faculty members.

All teaching staff, including part-time workers, are subject to certification.

Attestation commissions in order to confirm the compliance of employees with their positions are now independently formed by educational organizations. The frequency of certification has not changed - 1 time in 5 years. At the same time, employees who were absent from work due to illness for more than 4 months in a row undergo certification no earlier than one year after they start work.

Qualification categories (first or highest) are established for teaching staff at their request. Employees with a qualification category do not undergo certification in order to confirm their suitability for their position.

An application for the assignment of a category can be sent by mail or electronically. It can also be applied for while on parental leave.

The grounds for assigning qualification categories have been clarified. In case of refusal to establish a category, an employee can re-apply for its assignment only after a year.

Previously assigned qualification categories are retained for the period for which they were established.
