Information about the employee is entered into his work book in accordance with the Rules approved by Decree of the Government of the Russian Federation dated April 16, 2003 No. 225 and Instructions for filling out work books (Resolution of the Ministry of Labor of the Russian Federation dated October 10, 2003 No. 69 "On approval of the Instructions for filling out work books" ).

We have a prestigious educational institution, which employs highly qualified teachers with extensive teaching experience. Some time ago, we petitioned to award departmental awards to our distinguished teachers. In a solemn ceremony they were awarded Certificates of Honor from the Ministry of Education and Science of the Russian Federation. Now we don’t know whether we should reflect information about such awards in their work books.

    According to Art. 66 of the Labor Code of the Russian Federation (hereinafter referred to as the Labor Code of the Russian Federation), among other things, information about awards for success at work is entered into the employee’s work book. The employer has the right to independently determine whether his employee is worthy of promotion or not, and ultimately it is he who decides whether to reward a particular employee or not. But if the decision to reward the employee is made, an order (instruction) of the employer is issued to reward the employee, the corresponding entry must be made in the employee’s work book. And since it is the employee’s work book that is the main document about his work activity and work experience, entering into it information about awards for success at work seems necessary and in every sense logical.

    Clause 24 of the Rules for maintaining and storing work books, producing work book forms and providing them to employers (hereinafter referred to as the Rules; approved by Decree of the Government of the Russian Federation of April 16, 2003 No. 225 “On work books”) specifies information about which incentives are entered in the work book employee:
    a) on the awarding of state awards, including the conferment of state honorary titles, on the basis of relevant decrees and other decisions;
    b) on awarding Certificates of Honor, conferring titles and awarding badges, badges, diplomas, Certificates of Honor issued by employers;
    c) on other types of incentives provided for by the legislation of the Russian Federation, as well as collective agreements, internal labor regulations, charters and regulations on discipline.

    Each ministry determines its own list of departmental awards, approves regulations on such awards, defining the conditions and procedure for submitting them.

    Thus, the regulation on the Certificate of Honor of the Ministry of Education and Science of the Russian Federation was approved by order of the Ministry of Education and Science of the Russian Federation dated June 3, 2010 No. 580 “On departmental awards of the Ministry of Education and Science of the Russian Federation.”

    The Certificate of Honor is awarded to employees of the Ministry of Education and Science of the Russian Federation, employees of executive authorities of constituent entities of the Russian Federation and local governments that manage the field of education and (or) science, employees of educational and scientific organizations, regardless of their organizational, legal forms and forms of ownership.

    At its core, such a Certificate of Honor is a measure of departmental encouragement for teaching and research workers for conscientious and effective work in the education system or success in scientific activities. In this case, the diploma is awarded to employees who have worked in the relevant organization or body for at least five years.

    So, departmental awards are not state awards, and are also not provided for by local regulations of organizations as measures of employee incentives, but as measures of departmental incentives for success in work activities, they are also necessarily taken into account in the employee’s work book.

    In the context of clause 24 of the Rules on information about rewards entered into the employee’s work book, departmental awards for labor merits are among other types of rewards provided for by the legislation of the Russian Federation (in the case of the Certificate of Honor of the Ministry of Education and Science of the Russian Federation - by order of the Ministry of Education and Science RF dated 06/03/2010 No. 580 “On departmental awards of the Ministry of Education and Science of the Russian Federation”).

    In addition, paragraph 6 of the Regulations on the Certificate of Honor of the Ministry of Education and Science of the Russian Federation, approved by the above-mentioned order, states that an entry about the award of such a diploma is made in the work book of the awardee.

    It should be kept in mind that the decision to award a departmental award (Certificate of Honor) is made by the Ministry of Education and Science of the Russian Federation, and not by the employer. And it is formalized by a special order signed by the minister or deputy minister himself.

    It is on the basis of this order (its original or a copy provided by the employee) that the employer is obliged to make an appropriate entry about the promotion with a departmental award in the employee’s work book ( example 1).

    The deadline for making such an entry is not defined by law. On the one hand, paragraph 10 of the Rules states that all entries about awards made by the employer are entered into the work book on the basis of the relevant order (instruction) of the employer no later than a week. On the other hand, within the meaning of the existing wording, it turns out that this requirement about the period applies only to those incentives for work that are applied by the employer, and does not apply to incentives with state or departmental awards. In our opinion, in the current situation, the employer must make a record of awarding the employee with a Certificate of Honor within a reasonable time.

    State awards of the Russian Federation are the highest form of reward for citizens for their services in the field of state building, economics, science, culture, art and education, in strengthening the rule of law, protecting health and life, protecting the rights and freedoms of citizens, education, and the development of sports; for significant contribution to the defense of the Fatherland and ensuring the security of the state; for active charitable activities and other services to the state.

    a) General instructions

    2.1. Filling out work books and inserts for them is carried out in the language of the union, autonomous republic, autonomous region, autonomous district on the territory of which the given enterprise, institution, organization is located, and in the official language of the USSR.

    2.2. The work book is filled out for the first time by the administration of the enterprise in the presence of the employee no later than a week from the date of hiring.

    The following are entered in the work book:

    information about the employee: last name, first name, patronymic, date of birth, education, profession, specialty;

    information about work: hiring, transfer to another permanent job, dismissal;

    information about awards and incentives: awards of orders and medals, conferment of honorary titles; incentives for success in work applied by the workforce, as well as awards and incentives provided for by the internal labor regulations and discipline statutes; other incentives in accordance with current legislation;

    information about the discoveries for which diplomas were issued, about the inventions and innovation proposals used and about the remunerations paid in connection with this.

    Penalties are not recorded in the work book.

    2.3. All entries in the work book about hiring, transfer to another permanent job or dismissal, as well as about awards and incentives are made by the administration of the enterprise after issuing an order (instruction), but no later than a week, and in case of dismissal - on the day of dismissal and must accurately comply with the text of the order (instruction).

    Entries are made in Arabic numerals (day and month in two digits). For example, if a worker or employee was hired on January 5, 1984, in column 2 of the work book of the previously established sample (1938) it is written: “1984.05.01”, in work books issued after January 1, 1975: “05.01 .1984".

    Entries are made carefully, using a fountain or ballpoint pen, and black, blue or purple ink.

    2.4. With each entry made on the basis of an order (instruction) in the work book (insert) about hiring, transfers to another permanent job and dismissal, the administration is obliged to familiarize the owner of this book (insert) against a signature in a personal card (standard interdepartmental form N T -2, approved by the Central Statistical Office of the USSR), in which the exact entry from the work book (insert) must be repeated.

    Ministries and departments of the USSR and the Councils of Ministers of the Union Republics, in agreement with the relevant central committees and republican trade union councils, may, as an exception, allow enterprises operating in conditions of territorial disunity (subordinate structural units are located at a great distance) to familiarize themselves with the entries made in work books , in absentia by sending relevant notices to the owners of the books, followed by a note about this in the personal card (standard interdepartmental form N T-2, approved by the Central Statistical Office of the USSR).

    2.5. If an incorrect or inaccurate entry of information about work, transfer to another permanent job, awards and incentives, etc. is detected, correction is made by the administration of the enterprise where the corresponding entry was made. The administration of the new place of work is obliged to provide the employee with the necessary assistance.

    2.6. If necessary, the enterprise administration issues workers and employees, at their request, certified extracts of information about work from work books.

    2.7. If an enterprise that made an incorrect or inaccurate entry is liquidated, corrections are made by the legal successor, and in his absence - by the higher organization to which the liquidated enterprise was subordinated.

    2.8. Corrected information about work, transfers to another permanent job, awards and incentives, etc. must fully comply with the original order or instruction. If an order or instruction is lost or does not correspond to the work actually performed, correction of information about the work is carried out on the basis of other documents confirming the completion of work not specified in the work book.

    Witness testimony cannot serve as a basis for correcting previously made entries.

    2.9. In the sections “Information about work”, “Information about awards”, “Information about incentives” of the work book (insert), crossing out previously made inaccurate or incorrect entries is not allowed.

    If it is necessary, for example, to change the record of information about work after indicating the corresponding serial number, the date of entry, in column 3 it is written: “The entry for N so and so is invalid. Hired in such and such a profession (position)” and in column 4 the date and number of the order (instruction) of the administration, the entry from which was incorrectly entered into the work book.

    In the same manner, a record of dismissal and transfer to another permanent job is invalidated in the event of illegal dismissal or transfer established by the labor dispute resolution body, and reinstatement to the previous job or a change in the wording of the reason for dismissal. For example, it is written: “The entry for N so-and-so is invalid, reinstated to his previous job.” If the wording of the reason for dismissal is changed, the following is written: “The entry for N so-and-so is invalid, dismissed...” and the new wording is indicated.

    If there is an entry in the work book about dismissal or transfer to another job, which is subsequently declared invalid, at the request of the employee, a duplicate work book is issued without making an entry in it that was declared invalid.

    A duplicate work book is issued by the administration at the last place of work. Documents confirming work experience prior to entry into a given enterprise, institution, or organization are not required. At the same time, in the upper right corner of the first page of the new work book the following inscription is made: “Duplicate”. On the first page of the previous work book it is written: “In exchange, a duplicate was issued” and it is returned to the owner for subsequent submission to the social security authorities for documentary confirmation of work experience before entering work at the enterprise, institution, organization where the duplicate was issued.

    b) Entering information about the employee

    2.10. Information about the employee is recorded on the first page (title page) of the work book. Last name, first name and patronymic (in full, without abbreviation or replacement of first and middle names with initials) and date of birth are indicated on the basis of a passport or birth certificate.

    Education - secondary, specialized secondary and higher - is indicated only on the basis of documents (certificate, certificate, diploma).

    A record of incomplete secondary or incomplete higher education can also be made only on the basis of relevant documents (student card, grade book, certificate of educational institution, etc.).

    A profession or specialty is recorded in a work book on the basis of an education document or other properly executed document.

    2.11. After indicating the date of filling out the work book, the employee certifies with his signature the correctness of the information entered.

    The first page (title page) of the work book is signed by the person responsible for issuing work books, and after that the seal of the enterprise (or the seal of the personnel department) where the work book was first filled out is affixed.

    2.12. Changes to entries in work books about surname, name, patronymic and date of birth are made by the administration at the last place of work on the basis of documents (passport, birth certificate, marriage certificate, divorce, change of surname, name, patronymic, etc.) and with reference to the number and date of these documents.

    These changes are made on the first page (title page) of the work book. For example, the previous surname or first name, patronymic, date of birth are crossed out with one line and new data is recorded. Links to relevant documents are written on the inside cover and certified by the signature of the head of the enterprise or a person specially authorized by him and the seal of the enterprise or the seal of the personnel department.

    In the same manner, if necessary, changes are made to information about education, profession, and specialty.

    c) Entering information about work

    2.13. In column 3 of the “Work Information” section, the full name of the enterprise is written as a heading.

    Under this heading in column 1 the serial number of the entry being made is indicated, in column 2 the date of employment is indicated.

    In column 3 it is written: “Accepted or assigned to such and such a workshop, department, division, site, production” indicating their specific name, as well as the name of the job, profession or position and the assigned rank. Records about the name of the job, profession or position for which the employee is hired are made: for workers - in accordance with the names of professions specified in the Unified Tariff and Qualification Directory of Work and Professions of Workers; for employees - in accordance with the names of positions specified in the Unified Nomenclature of Employee Positions, or in accordance with the staffing table.

    Changes and additions made in the prescribed manner to the specified directory, as well as to the Unified Nomenclature of Employee Positions or the staffing table, are brought to the attention of workers and employees, after which appropriate changes and additions are made to their work books on the basis of an order (instruction) of the administration.

    If a worker is assigned a new rank during the period of work, then a corresponding entry is made about this in the prescribed manner.

    The establishment of a second and subsequent profession for a worker is noted in the work book indicating the categories of these professions. For example, a repairman was assigned a second profession - electric and gas welder with the assignment of 3rd category. In the work book it is written: in column 1 of the section “Information about work” the serial number of the entry is entered, in column 2 - the date of establishment of the second profession, in column 3 it is written: “The second profession has been established - electric and gas welder with the assignment of 3rd category”, in column 4 the corresponding ID, its number and date.

    When performing work in a newly established profession, a corresponding entry about this is made in the work book. For example, it is written: “A second profession has been established - electric and gas welder with the assignment of the 3rd category with the assignment of duties for performing electric and gas welding work in such and such production,” in column 4, along with indicating the corresponding certificate of establishment of the second profession, its number and date, a reference is made to the date and order number.

    Work as part of specialized or complex teams is also noted in the work book, while simultaneously indicating the combination of several professions.

    When appointed as a foreman of a production team, a corresponding entry is made in the work book with reference to the order (instruction) of the head of the enterprise or the head of the production unit, workshop or other structural unit.

    When a foreman is released from leading a team in the cases and in the manner prescribed by the relevant industry regulations on the production team, the council of the team and the council of foremen, an entry is made in the work book: “Relieved from leading the production team.”

    Entry into the work book of information about part-time work is carried out at the request of the employee by the administration at the place of main work on the basis of orders (instructions) of the administration of the enterprise, institution, organization where the employee is hired for part-time work.

    The transfer of an employee to another permanent job at the same enterprise is formalized in the same manner as hiring.

    2.14. If during the work of a worker or employee the name of the enterprise changes, then an entry is made about this in a separate line in column 3 of the work book: “Enterprise such and such has been renamed to such and such date,” and in column 4 the basis for the renaming is entered - an order (order), its date and number.

    2.15. For students, students, graduate students and clinical residents who have work records, the educational institution (scientific institution) makes records of the time of study in full-time departments (including preparatory ones) of higher and secondary specialized educational institutions, in party schools and schools of the trade union movement. The basis for such records are orders of the educational institution (scientific institution) on enrollment and expulsion from students, students, graduate students, and clinical residents.

    The period of work of these students, pupils, graduate students and clinical residents in student teams, during industrial practice and when carrying out scientific research contractual topics is confirmed by an appropriate certificate indicating the specialty, qualifications, position and time of work. Based on these certificates, educational institutions (research institutions) ensure that information about work is entered into the work books of students, students, graduate students and clinical residents according to the data received. The certificates are stored in the personal files of the indicated persons as documents of strict accountability.

    2.16. For students, students, graduate students and clinical residents who have not previously worked and therefore do not have work books, information about work in student teams, on industrial practice, as well as about the implementation of scientific research contractual topics on the basis of certificates is entered by the enterprise where in the future they will work.

    2.17. The following entries are entered in the work books at the place of work as a separate line with reference to the date, number and name of the relevant documents:

    a) about the time of service in the Armed Forces of the USSR, in the bodies of the State Security Committee of the USSR and the Ministry of Internal Affairs of the USSR, in all types of security, where those serving are not covered by labor legislation and state social insurance, indicating the date of conscription (enrollment) and dates of separation from service;

    c) about the time of study in higher and secondary specialized educational institutions (including the time of work in student teams, on industrial practice and when carrying out research and economic contractual topics), party schools, trade union schools and about the time spent in graduate school and clinical residency, except cases specified in clause 2.15 of these Instructions;

    d) about work as a member of a collective farm - in cases where the current legislation provides for the inclusion of this work in the total length of service of workers and employees.

    The entries provided for in this paragraph are made in the work book before entering information about work at this enterprise.

    2.18. When continuous work experience is restored in accordance with the established procedure for the purpose of granting benefits for state social insurance, the following entry is made in the work book of a worker or employee at the last place of work in column 3 of the section “Information about work”: “Continuous work experience was restored from such and such a date, month, year", in column 4 reference is made to the resolution of the presidium of the relevant trade union council.

    For workers engaged in seasonal work in those sectors of the national economy where the current legislation allows the summation of periods of seasonal work and the preservation of continuous work experience when returning to seasonal work within the prescribed period after an off-season break, the following entry is made in column 3 of the specified section of the work book: “Continuous work experience work is saved."

    2.19. In the work books of persons who have served correctional labor without imprisonment, the administration of the enterprise at the place of work makes an entry that the time worked during this period is not counted in the total and continuous work experience (section “Information about work” of the work book, column 3).

    Since 1992, the time spent by convicted persons while serving a sentence of imprisonment has been counted towards their total length of service. - Law of the Russian Federation of June 12, 1992 N 2988-1.

    In cases where the court, in accordance with the procedure established by law, includes the time of serving correctional labor without imprisonment in the total length of service, an entry is made in the work books that this time is not counted towards the continuous length of service.

    These entries are entered into work books at the end of the actual term of serving the sentence, which is established according to certificates from the USSR Ministry of Internal Affairs.

    When a convicted person is dismissed from work in the manner prescribed by current legislation and he is hired at a new place of work, the corresponding entries are made in the work book by the enterprise to which the convicted person was hired or sent.

    The basis for making entries in the work books provided for in this paragraph is an order (instruction) of the head of the enterprise, issued in accordance with the verdict (ruling) of the court.

    The following entries are made in the “Work Information” section of the work book:

    Column 1 indicates the serial number of the entry; in column 2 - the date of entry; in column 3 it is written: “Work time from such and such a date (day, month, year) to such and such a date (day, month, year) is not counted in the total and continuous work experience.”

    When the court includes the time of serving correctional labor in the total length of service, in column 3 it is written: “The time of work from such and such a date (day, month, year) to such and such a date (day, month, year) is not counted in the continuous work experience.” .

    Column 4 indicates the basis for making an entry in the work book - an order (instruction) from the head of the enterprise, the date of its publication and number.

    2.20. The issues of invalidating the relevant entries made in the work books of citizens released from work (position) in connection with an illegal conviction or removed from office in connection with illegal criminal prosecution, and issuing duplicate work books to them are regulated by Article 5 of the Regulations on the Procedure for Compensation damage caused to a citizen by illegal actions of the bodies of inquiry, preliminary investigation, prosecutor's office and court, approved by the Decree of the Presidium of the Supreme Soviet of the USSR of May 18, 1981, and the issues of entering relevant entries into work books for persons sentenced to deprivation of the right to hold certain positions or engage in certain activities , and on the procedure for issuing a duplicate work book to them - Article 6 of the Regulations on the procedure and conditions for the execution of criminal penalties not related to measures of corrective labor influence on convicts, approved by the Decree of the Presidium of the Supreme Soviet of the USSR of March 15, 1983. A duplicate work book is issued to the specified persons in the manner established by paragraph 2.9 of these Instructions.

    d) Entering information about awards and incentives

    2.21. In the work books of workers and employees, the following information is entered in the section “Information on awards”:

    a) on awarding orders and medals and conferring honorary titles on the basis of decrees of the Presidium of the Supreme Soviet of the USSR and decrees of the Presidiums of the Supreme Soviets of the union and autonomous republics; on awarding certificates of honor to the Presidiums of the Supreme Councils of the Union and Autonomous Republics;

    b) on conferring the titles: “Lenin Prize Laureate”, “State Prize Laureate”;

    c) on awarding diplomas and badges on the basis of decisions of the All-Union Central Council of Trade Unions;

    d) on awarding and conferring honorary titles on the basis of decisions of the Komsomol Central Committee;

    e) on the assignment of titles and awarding with badges, badges, diplomas, certificates of honor, carried out in accordance with the legislation by ministries, departments, executive committees of the Councils of People's Deputies jointly or in agreement with the relevant trade union bodies (for example, awarding the title "Honorary Miner", "Honorary Miner" metallurgist", "Honorary Miner", awarding the title of the best worker in this profession, awarding a diploma of honor from the ministry and the Central Committee of the trade union, awarding all-Union badges to the winners of socialist competition, etc.);

    2.22. In work books of the 1938 model, previously provided awards (clause 29 of the Instructions on the procedure for maintaining work books at enterprises, institutions and organizations, approved by Resolution of the State Committee for Labor of June 20, 1974 N 162), received after January 1, 1975, are entered in the section "Information about incentives and awards." Newly introduced awards (for example, medals and diplomas from the USSR Exhibition of Economic Achievements of the USSR) received after January 1, 1986 are also entered into the same section of the work book of the previously established sample (1938).

    2.23. In the work books of workers and employees, the following information is entered in the section “Information on incentives”:

    a) On incentives for success in work applied by labor collectives in accordance with the Law of the USSR “On labor collectives and increasing their role in the management of enterprises, institutions, organizations”;

    b) On incentives for success in work at an enterprise, institution, organization, provided for by the internal labor regulations and discipline statutes (declaring gratitude, issuing a bonus, awarding a valuable gift, awarding an enterprise diploma, entering in the Book of Honor, on the Honor Board and etc.), as well as about incentives received by workers and employees on collective farms, state farms and other state agricultural enterprises during the period of assistance to these farms;

    c) On other incentives in accordance with current legislation;

    d) About the discoveries for which diplomas were issued, about the inventions used and rationalization proposals and about the rewards paid in connection with this.

    The work books do not record bonuses provided for by the wage system or the payment of which is regular.

    2.24. The procedure for entering information about awards and incentives is as follows: in column 3 of the corresponding section of the work book, the name of the enterprise is written as a heading; below in column 1 the serial number of the record is indicated (numbering increasing throughout the entire period of the employee’s work activity); Column 2 indicates the date of award or promotion; Column 3 records who awarded or encouraged the employee, for what achievements and with what award or encouragement; Column 4 indicates the basis on which the entry was made (with reference to the date, number and name of the document).

    When an employment contract is terminated at the initiative of a worker or employee for reasons that the law relates to the provision of certain benefits and benefits, a record of dismissal is made in the work book indicating these reasons. For example, “Dismissed of his own free will in connection with enrollment in a higher educational institution, Article 31 of the Labor Code of the RSFSR” or “Dismissed of his own free will in connection with the assignment of a Komsomol permit to construction (the name of the shock Komsomol construction site is indicated), Article 31 of the Labor Code of the RSFSR ".

    When an employment contract is terminated at the initiative of a worker or employee in connection with a move to another locality in the order of an organized recruitment of workers, an entry about the dismissal is made in the work book indicating this reason. For example, “Dismissed at his own request due to being sent to work on an organized recruitment of workers to work at an enterprise (a specific enterprise is indicated), Article 31 of the Labor Code of the RSFSR.”

    2.26. An entry about dismissal in an employee’s work book is made in compliance with the following rules: in column 1 the serial number of the entry is entered; in column 2 - date of dismissal; in column 3 - the reason for dismissal; Column 4 indicates the basis on which the entry was made - the order (instruction), its date and number.

    The day of dismissal is considered the last day of work.

    For example, an employment contract with an employee is terminated due to staff reduction. October 10, 1986 is his last day of work. The following entry must be made in the employee’s work book: in column 1 of the “Work Information” section, the serial number of the entry is entered, in column 2 - the date of dismissal (10.10.1986), in column 3 it is written: “Dismissed due to staff reduction, clause 1 Article 33 of the Labor Code of the RSFSR", column 4 indicates the date and number of the order (instruction) on dismissal.

    2.27. When transferring from one enterprise to another by order of higher authorities, by agreement between the heads of enterprises, or by decision of the relevant party and Soviet bodies, as well as trade union and Komsomol organizations, a reference to the agreement or decision of these bodies and organizations is written in column 3.

    Examples: “Dismissed due to transfer to work in such and such an enterprise by order of such and such a ministry, clause 5, article 29 of the Labor Code of the RSFSR.”

    When transferring to an elective position, an entry is made in column 3: “Dismissed due to election to an elective position in such and such an organization, clause 5, article 29 of the Labor Code of the RSFSR.”

    2.28. When terminating an employment contract at the initiative of the administration in connection with the implementation of measures to improve the organization of management of industry and other sectors of the national economy, in addition to the grounds provided for by current legislation, reference is made to the corresponding decision of the Government of the USSR. For example, in column 3 it is written: “Dismissed due to a reduction in staff (or number) of employees, clause 1 of Article 33 of the Labor Code of the RSFSR” and then the corresponding resolution of the Council of Ministers of the USSR is indicated in parentheses.

    2.29. When an old-age pension, a long-service pension, or a personal pension are assigned, the social security authorities put a stamp “Pension assigned” in the work book. The stamp is placed in the “Information on the assignment of pension” section. In work books of the previously established sample (1938), the indicated stamp is placed on the first page.

    For exemplary employees whose achievements they want to reward, the labor code provides:

    The specific grounds, as well as the procedure for awarding awards and making relevant records, are not regulated by law. This means that each company can independently make a decision and approve its own regulations for this procedure. In practice, this sequence of actions is followed.

    Step 1. Deciding on the award

    The decision-making procedure has its own characteristics depending on the specific company. Typically, the immediate supervisor of a distinguished employee (for example, the head of the sales department) takes the initiative and draws up an application addressed to management. The director of the company makes a positive decision, after which the type and form of remuneration is determined.     Step 2. Completing an order

    Step 3. Making an entry in the labor record
